Moreover, we are not liable for any inconvenience caused or expense incurred as a result of any unsuitability of travel product or service used in association with other travel services. The travel agent's role in relation to your travel arrangements is limited to facilitating your booking and arranging travel documentation, payments and refunds as applicable. However, to the maximum extent permitted by law, NewZealandMyWay.com rejects all liability for any corruption of any data, technical errors, inaccuracies in information supplied by third parties, unauthorized access to your personal data, or failure by NewZealandMyWay.com to complete bookings where that failure is due to circumstances beyond our control.
- e) NewZealandMyWay.com accepts no responsibility or liability for any incomplete booking or delay on the part of any third party supplier in providing travel services to you where your booking has been properly processed by NewZealandMyWay.com. We also accept no responsibility or liability for omissions of third parties in the course of delivery of travel services. Where NewZealandMyWay.com is liable to you under these terms and conditions its liability will be limited to providing the relevant booking services again or to refund money paid in relation to services not provided because of NewZealandMyWay.com’s default. Where refunds are due to you from third party suppliers of travel products or services, NewZealandMyWay.com will provide reasonable assistance to you in claiming such funds from those suppliers. Under no circumstances will NewZealandMyWay.com be liable for direct, indirect, consequential or incidental damages including but not limited to lost profits or savings, unforeseen cancellations or damages should you be unhappy with you purchases.
- f) The NewZealandMyWay.com website may include travel blogs and information from users regarding the quality, value and other information about suppliers listed on this site. NewZealandMyWay.com does not represent or necessarily endorse the information posted by users not employeed by NewZealandMyWay.com however reserves the right to remove information we feel may not be accurate or truthful. As a user of this website you acknowledge that any reliance on material posted by other members will be at your own risk.
5. Warranties:
To the maximum extent permitted by law, NewZealandMyWay.com grants no warranties, express or implied, regarding this travel website and any service or facilities provided. The site and any service or facility we offer is provided as what you see is what you get. NewZealandMyWay.com will not be liable to you for the breach of any alleged warranty.
6. Payment:
Payment is required by Credit Card or bank transfer at the time of Booking. If the booking is changed after the booking is made there may be an additional cost which NewZealandMyWay.com will inform you of within 24 hours. We do not hold your credit card information and can not process additional payments automatically. If a refund is required as a result of a cancellation, we will refund the amount net of any possible cancellation fees within one working day.
7. Supplier Terms and Conditions and Cancellation and Amendment Charges:
In addition to these Terms and Conditions, listed suppliers may have specific requirements that will be shown at the time of adding a service to you itinerary. It is up to you to read these carefully. They may include booking fees, cancellation fees and amendment fees in cases where amendment is permitted. In some cases, NewZealandMyWay.com may charge cancellation and/or amendment fees in addition to those imposed by travel service providers where additional resources have been used to manage the changes.
8. Termination:
You agree that NewZealandMyWay.com may terminate your use of this website if we believe that you have abused these Terms and Conditions, the rights of NewZealandMyWay.com or any of our third party, for any reason with or without notice to you. You agree that NewZealandMyWay.com may modify or cease operation this website, with or without notice to you. You agree that NewZealandMyWay.com will not be liable to you or any third party as a result of such modification or discontinuation. NewZealandMyWay.com reserves the right to remove accounts that are deemed or believed to be inaccurate, fraudulent, inactive, or have not been accessed for some time.
9. Jurisdiction:
NewZealandMyWay.com is a New Zealand based legal entity and this agreement is governed by the laws of New Zealand. You hereby consent to the exclusive jurisdiction of courts in New Zealand, in all disputes arising out of or relating to the use of this website.
